1. General Terms

1.1 This agreement governs the use of the Wireless Internet Industry Executives (WIIE) group which is hosted on the world wide web at http://www.wiie.org. WIIE is a professional networking organization and General Partnership based in Rowlett, TX. This agreement is between the user (also referred to as “member”) of the WIIE website and WIIE.

2. Use of Content

2.1 The WIIE website contains information, photographs, images, graphics, links, and other material (collectively, the “Content”) that are protected by copyright, trademark or other proprietary rights of WIIE or third parties. All Content on the WIIE website is copyrighted as a collected work of WIIE, pursuant to applicable copyright law. Users of the WIIE website may use the Content only for their personal, noncommercial use.

2.2 All trademarks and copyrights presented on the WIIE website inure to their respective owners.

2.3 User may not modify, publish, distribute, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any other way exploit the Content, in whole or in part, except as expressly permitted in this Agreement.

2.4 User may download, copy, or print the Content only for user’s own personal use, provided that user maintains all copyright and other notices contained in such Content. Except as expressly permitted by the copyright laws, no copying, storage, redistribution, or publication of any Content is permitted without the express written permission of WIIE Content may be e-mailed to others using the e-mail utility on this website.

3. No Endorsement

3.1 The WIIE website may contain links to sites on the Internet which are owned and operated by third parties (the “External Sites”). User acknowledges that WIIE does not endorse, nor is it responsible for the availability of, or the content located on or through, any External Site.

4. Indemnity

4.1 User agrees to indemnify, defend, and hold WIIE and its affiliates, and their respective officers, directors, owners, agents, information providers and licensors (collectively, the “WIIE Parties”) harmless from and against any and all claims, liability, losses, costs and expenses (include attorneys’ fees) incurred by any WIIE Party in connection with any use or alleged use of the WIIE website.

5. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILTY

5.1 NEITHER WIIE NOR ANY PROVIDER OF THIRD PARTY CONTENT OR THEIR RESPECTIVE AGENTS WARRANTS THAT THE WIIE WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES WIIE, ANY THIRD PARTY CONTENT PROVIDER, OR THEIR RESPECTIVE AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE WIIE WEBSITE OR THE CONTENT. THE WIIE WEBSITE AND THE CONTENT ARE DISTRIBUTED ON AN “AS IS, AS AVAILABLE” BASIS. NONE OF WIIE, THIRD PARTY CONTENT PROVIDERS AND THEIR RESPECTIVE AGENTS MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE WIIE WEBSITE, ANY CONTENT OR ANY PRODUCTS OR SERVICES SOLD THROUGH THE WIIE WEBSITE, NOR ANY PRODUCTS AND SERVICES LINKED FROM THIS SITE.

5.2 NEITHER WIIE, ANY THIRD PARTY CONTENT PROVIDER, NOR THEIR RESPECTIVE AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE WIIE WEBSITE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES.

5.3 SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF WIIE, THIRD PARTY CONTENT PROVIDERS, AND THEIR RESPECTIVE AGENTS SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

5.4 DISCLAIMER: All views and opinions contained in the columns, interviews, web logs (“blogs”) or other articles on this site are solely the opinion of the writer(s), and do not necessarily reflect the opinions of WIIE .

6. Miscellaneous

6.1 This Agreement shall be construed in Accordance with the laws of the State of Texas.
